Drip and Dip Customer Terms of Service

 

Effective Date: April 14, 2025

PLEASE READ THESE TERMS OF SERVICE CAREFULLY. By accessing our website at  https://dripanddip.com/, downloading our mobile app, clicking “I Agree,” checking a box to accept, or otherwise using our services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service (“Terms”). If you do not agree, do not use our services.

 

ARBITRATION NOTICE: By agreeing to these Terms, you agree that disputes with Drip and Dip or our partnered medical providers will be resolved through binding individual arbitration, and you waive rights to a jury trial or class action lawsuits, as detailed below.

 

MEDICAL EMERGENCY NOTICE: If you have a medical emergency, call 911 or seek in-person care immediately. Our services are not suitable for all medical conditions.

  1. Introduction

Drip and Dip LLC (“Drip and Dip,” “we,” “us”) operates www.dripanddipiv.com and the Drip and Dip mobile app (collectively, the “Platform”). We provide booking and membership services (the “Service”) to connect users with licensed healthcare providers for IV hydration and wellness treatments. These Terms govern your use of the Platform and Service.

“You” refers to the user or, for minors aged 13–17, includes the parent/legal guardian providing consent. Individuals under 13 are prohibited from using the Service. Contact us at  info@dripanddip.com if you believe an unauthorized minor has used our Service.

  1. Acceptance of Terms

By using the Service, you agree to comply with these Terms and all applicable laws. We may update these Terms at any time, with changes effective upon posting to the Platform. Continued use after changes constitutes acceptance. If you disagree, stop using the Service.

  1. Our Role and Medical Disclaimer

Drip and Dip operates the Platform to schedule IV hydration and wellness services provided by third-party medical groups and licensed providers (“Medical Providers”). We are not a medical provider and do not provide healthcare services ourselves.

  • Third-Party Services: Medical Providers, pharmacies, and labs deliver all medical care, prescriptions, or lab services booked through us. These parties are third-party beneficiaries of these Terms.
  • No Doctor-Patient Relationship with Us: Using our Service may establish a provider-patient relationship with Medical Providers, not Drip and Dip.
  • Responsibility: Medical Providers control all healthcare decisions. We are not liable for their services or your care outcomes.
  • Communications: You may receive treatment-related messages from Medical Providers via the Service. You are responsible for monitoring and responding to these, and we are not liable for any issues arising from your failure to do so.
  1. No Insurance; Your Financial Responsibility

We do not accept health insurance, Medicare, or Medicaid. All services are cash-based, and you are solely responsible for all costs, including those charged by Medical Providers, pharmacies, or labs. Neither you nor we will submit claims to insurance or government programs.

  1. Memberships and Subscriptions

Some services, like our Drip Memberships, are subscription-based with auto-renewal:

  • Billing: Your payment method is charged monthly until cancellation, with a three-month minimum commitment.
  • Cancellation: Cancel anytime up to 48 hours before renewal via https://dripanddip.com/info@dripanddipiv.com
  • Fees: Memberships exclude travel or additional service fees, disclosed at checkout.
  • Total Price: Includes our fees and amounts collected for Medical Providers or pharmacies, as applicable.
  1. Lab Services
  • Labs: At-home testing kits or lab services require a provider’s order and are fulfilled by partnered labs. Follow kit instructions to avoid processing issues.
  • Third-Party Goods: Prescriptions and lab services are provided by third parties, subject to their terms.
  1. Payments
  • Authorization: You authorize us to charge your payment method for all fees, including third-party charges, via our processor Square
  • Non-Refundable: Fees are non-refundable unless stated in our return policy.
  • Taxes: You are responsible for applicable taxes, estimated at checkout.
  • Errors: We may correct pricing errors, adjust orders, or cancel and refund if products are unavailable.
  • Failed Payments: You must provide an alternative payment method if charges fail. Services are not provided until payment is verified.
  1. Eligibility and Restrictions
  • Age: Users must be 18+
  • Location: Available only in regions we serve, subject to local laws.
  • Use: You agree to use the Service lawfully, provide accurate information, and consult providers from your registered state.
  1. Telehealth Consent

IV hydration and wellness services may involve telehealth. You must review and agree to a telehealth consent form provided via the Service, acknowledging potential benefits and risks. Drip and Dip is a third-party beneficiary of this consent.

  1. Privacy and Protected Health Information
  • Privacy Policy: See our Privacy Policy for how we handle personal information.
  • Health Information: Medical information provided to Medical Providers may be protected under laws like HIPAA. We are not a HIPAA-covered entity unless acting as a business associate for providers. Non-medical information (e.g., name, email) is subject to our Privacy Policy.
  • Notice: By using the Service, you acknowledge receipt of Medical Providers’ Notice of Privacy Practices.
  1. User Accounts and Security
  • Registration: You must create an account with accurate information and secure your login credentials.
  • Responsibility: You are liable for unauthorized use if you fail to protect your account. Notify us at info@dripanddipiv.com of any breaches.
  • Security: We use encryption (e.g., SSL) but cannot guarantee absolute security due to external factors.
  1. Prohibited Uses

You may not:

  • Use the Service unlawfully or to harm others.
  • Interfere with the Platform’s operation or security.
  • Impersonate others, send spam, or upload harmful content.
  • Reverse-engineer or misuse the Service.

We may suspend or terminate accounts for violations and cooperate with law enforcement if needed.

  1. Intellectual Property
  • Ownership: We own the Platform, content, and trademarks (e.g., “Drip and Dip”). You are granted a limited, revocable license for personal use.
  • Submissions: Non-confidential information you submit (e.g., feedback) may be used by us globally, royalty-free, except for protected health information, which is subject to applicable laws.
  1. Third-Party Services

Medical Providers, pharmacies, and labs are independent third parties. Your interactions with them are at your own risk, and we are not liable for their actions or products. Some of our personnel may have financial interests in these third parties.

  1. Termination

We may terminate your access for any reason, including violations of these Terms. Provisions on security, liability, arbitration, and indemnification survive termination. You may not re-access the Service post-termination without permission.

  1. Disclaimers

The Service is provided “as is.” We and our third-party providers disclaim all warranties (e.g., merchantability, fitness for purpose). We do not guarantee the Service’s accuracy, reliability, or uninterrupted operation.

  1. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages (e.g., lost profits, emotional distress).
  • Claims must be filed within one year.

Some jurisdictions may limit these exclusions, applying the minimum permitted by law.

  1. Indemnification

You agree to indemnify Drip and Dip, its affiliates, and third-party providers against claims arising from your use, fraud, or breach of these Terms, including legal fees.

  1. Arbitration and Class Action Waiver
  • Binding Arbitration: Disputes with us or Medical Providers will be resolved by confidential arbitration through the American Arbitration Association (AAA) in Los Angeles CA, unless another location is agreed.
  • Rules: Governed by AAA’s Commercial Arbitration Rules. Costs follow AAA’s fee schedule, but we may cover your share if prohibitive.
  • No Class Actions: Disputes are individual only; no class or representative claims are allowed.
  • Exceptions: Intellectual property or small claims disputes may go to court in [insert city].
  • Notice: You must send a written dispute notice to [insert address, e.g., Drip and Dip LLC, 123 Wellness Way, Miami, FL 33101] before arbitration. We have 30 days to resolve informally.
  • Severability: If class action limits are unenforceable, those claims go to court; others remain in arbitration.
  1. Governing Law

These Terms are governed by California law and the Federal Arbitration Act, without regard to conflict of laws. Any non-arbitrable claims will be heard in Los Angeles, CA courts.

  1. Entire Agreement

These Terms, along with our Privacy Policy and any executed agreements, constitute the full agreement between you and Drip and Dip, superseding prior agreements.
